Terms of Use

These Terms of Use ("Terms") form an agreement between you ("User", "you") and Bruno Vinicius Rosa Cristiano - BVRC E-Sport, Brazilian Tax ID (CNPJ) 36.876.158/0001-77, registered at Rua Toronto, 218, Jardim Canadá, Maringá - PR, Brazil, ZIP 87080-570 ("Orça Voz", "we"), and govern your use of the website orcavoz.com.br and the Orça Voz application (the "Service").

By checking the acceptance box at sign-up, creating an account, or using the Service, you declare that you have read, understood, and agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and registration

The Service is intended for individuals over 18 years of age with full legal capacity, or for properly represented legal entities. You are responsible for keeping your credentials confidential and for all activity carried out on your account, and for keeping your account information true and up to date.

2. Description of the Service

We let you record an audio memo describing a job, have that audio transcribed and organized by artificial intelligence into a structured quote, edit that quote, generate a professional PDF, and share it with your clients by link, WhatsApp, or email. Orça Voz is a support tool — we do not provide consulting, engineering, accounting, or legal services, and the generated content does not replace the technical or commercial analysis that any given quote may require.

3. Data of the clients you enter

When you enter data about one of your own clients (name, amounts, service context), you represent that you have an adequate legal basis to process that information, generally the performance of a contract or a negotiation requested by that client. In that relationship, you act as the data controller and Orça Voz acts as the processor, handling the data only to make the quote possible at your request.

4. Plans, billing, renewal, cancellation, and refunds

• Your first quote is free, no card required.
• From then on, features such as PDF download and sharing require a paid subscription, billed monthly through Stripe.
• The subscription renews automatically at the same price, unless we give prior notice of a price change.
• Cancel anytime, without justification, through the Customer Portal — access continues until the end of the period already paid for, with no penalty.
• Refund requests are reviewed case by case, in accordance with Stripe's policy and applicable consumer protection law. We do not process or store full card data — that is handled directly by Stripe.

5. Intellectual property

The software, brand, layout, and content of Orça Voz belong to Bruno Vinicius Rosa Cristiano - BVRC E-Sport. You receive only a limited, revocable license to use it. The data you enter (quotes, clients, catalog) remains yours — you grant Orça Voz only the license necessary to process and display that content while you use the Service.

6. Artificial Intelligence

The text of your transcription is processed by third-party AI (OpenAI) to organize the quote. AI systems can make mistakes, omit information, or generalize — it is your responsibility to review and correct the quote before sending it to your client. Raw audio is never stored, and we do not use audio, transcripts, or quotes to train AI models.

7. Audio and third-party data

Preferably use your own voice. Do not record conversations or the voices of third parties improperly, without consent or another applicable legal basis.

8. Acceptable use

You agree not to:

• enter third-party data without an adequate legal basis;
• improperly record the voices of third parties;
• submit illegal, defamatory, discriminatory, or fraudulent content;
• attempt to access other users' data or accounts;
• attack, overload, or attempt to compromise the security of the Service;
• circumvent technical or billing limits, including through multiple accounts.

9. Integrations

Sharing via WhatsApp uses the standard wa.me link, which only pre-fills a message in your own WhatsApp — we do not access or store your conversations. Email delivery uses Resend as technical infrastructure. Google login is processed directly by Google.

10. Availability and warranties

We make reasonable efforts to keep the Service available, but we do not guarantee uninterrupted or error-free operation. The Service is provided "as is", with no warranties beyond those required by law, without prejudice to consumer rights.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect damages, lost profits, or business decisions made based on generated quotes — the final review is always yours. Nothing here excludes liability that cannot be legally excluded, nor any non-waivable consumer rights.

12. Suspension and termination

We may suspend or terminate accounts that violate these Terms, with notice whenever possible. You may close your account at any time, without justification, under Privacy and data → Delete my account — deletion is final.

13. Changes to these Terms

We may update these Terms. Material changes will be communicated by email and/or within the Service itself. Continuing to use the Service after a change constitutes acceptance, but you may close your account if you disagree.

14. Governing law and jurisdiction

These Terms are governed by Brazilian law. If you are a consumer, the courts of your domicile apply; in all other cases, the courts of the Comarca de Maringá - PR, Brazil, have exclusive jurisdiction.
